Once a law is in force it is a LAW IN FORCE for EVERYONE,
also for Congressional legislators.
They can repeal such a law, if they have the necessary majorities in the House and the Senate. Otherwise, they are obligated to OBEY the law.
Any concerted attempt to violate rights granted by such a law, as is currently being done by the House of Representatives with respect to Obamacare, appears to this observer to be a clear criminal violation of Title 18 of the U.S. Code 18 USC § 241 - Conspiracy against rights | Title 18 - Crimes and Criminal Procedure., which provides:
"If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same ....By using the national government budget as an extortionist device to achieve government shutdown, the members of the House of Representatives who are refusing to pass a budget and using that as leverage to deprive American citizens of their RIGHTS, are conspiring to get rid of Obamacare without a legitimate legislative repeal of this law and are thus conspiring to keep people from getting the affordable health care guaranteed to them by that law.
They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section ... they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death." "Defunding" Obamacare by extortion would clearly and unavoidably lead to avoidable injuries and deaths among people now uninsured, as referred to in 18 USC § 241.
Obamacare is A LAW IN FORCE and must be followed and the rights provided therein MUST be granted, because it IS THE LAW. Congressmen and Congresswomen who have participated in the conspiracy should be held criminally liable for the consequences of not following that law by their refusal to fund it.
This "Conspiracy against rights" provision of the U.S. laws can in principle also be applied to officers of the individual States who can be proven guilty of conspiring to keep people from enjoying the rights granted to them by Obamacare, which, whether they like it or not, is THE LAW.
There are many laws we ourselves do not like. This does NOT excuse us or anyone else from depriving others of the rights those laws in force grant. If you want laws repealed, you do it the standard way, or not at all.
