Harvard Law Professor Charles Fried calls Elena Kagan "Everyone's Dean" : But Does this Make Her "Everyone's Justice"?

Harvard Law School has just published an announcement about Professor Charles Fried and his article in the New Republic about Everyone's dean, Elena Kagan:

"In The New Republic, HLS Professor Charles Fried wrote "Everyone's Dean: Why Elena Kagan has earned the respect of conservatives, like me," an article which appeared in the April 19 edition of the magazine. Fried teaches constitutional law and contracts at HLS, where he has been on the faculty since 1961. He was solicitor general of the United States during the second Reagan administration and from 1995 to 1999 he was an associate justice on the Massachusetts Supreme Judicial Court."

The respect that Kagan has earned from many quarters is remarkable, but this has little do with the question of whether Kagan is a sensible nomination for the Supreme Court, where her apparently undisputed talents in dealing with people, would,  in our opinion, seem to be submerged under the rock of the law and be confined foolishly to judicial chambers. The more that we read about why people like her, the more we are convinced that she should stay in public life and OUT of the court.

Worth reading is an end-of-March posting at the EETimes.com by Rick Merritt Supreme Court expected to rule on Bilski case soon which quotes Kevin E. Noonan and Wesley D. Blakeslee to the effect that they do not expect Bilski to be reversed but that the Supremes might refine the Federal Circuit's machine-or-transformation test.
